If you die without a Will you are said to die intestate and in such circumstances, your estate will be distributed in accordance with a strict legal formula set out in the Succession Act 2006 (NSW).

A Power of Attorney is a legal document by which you appoint and authorise a person(s) to manage your legal and financial affairs. Generally, the authority provided under a Power of Attorney extends to the sale and purchase of real and personal property, operation of bank accounts and payment of debts. However, the precise scope of authority afforded to your attorney can be limited and/or specified.
There are two types of Power of Attorney:
• General Power of Attorney – A General Power of Attorney ceases to have legal effect when you become incapacitated or otherwise incapable of providing instructions to your attorney. Accordingly, a General Power of Attorney offers a flexible method of managing your legal and financial affairs for temporary periods of absence such as where you are overseas.
• Enduring Power of Attorney – An Enduring Power of Attorney continues to have legal effect if you become incapacitated or otherwise incapable of providing instructions to your attorney. The distinct benefit of having and Enduring Power of Attorney is that it will continue to be operative in circumstances where through accident/misadventure, degenerative illness or other means you become from a legal standpoint, incapable of managing your own affairs.
An Enduring Guardianship is a legal document by which you appoint and authorise a person(s) to manage your lifestyle and medical decisions. An Enduring Guardianship only becomes legally operative when you lose the capacity to make lifestyle and medical decisions for yourself.
Having a valid and legally enforceable Enduring Guardianship in place provides security and protection in the event that accident/misadventure, degenerative illness or other means causes you to lose the capacity to make lifestyle and medical decisions for yourself. If you lose the capacity to make these types of decisions and do not have and Enduring Guardianship in place, an application will need to be made to the Guardianship Division of the NSW Civil and Administrative Tribunal to have a guardian appointed for you. If no one suitable is available to be your guardian, the NSW Civil and Administrative Tribunal may appoint an independent public official to be your guardian.
A Power of Attorney and an Enduring Guardianship are complementary legal documents that can be made separately or together.
